TERMS OF SERVICE
Welcome to our food club!
As a member of the Association, the Member is entitled to obtain food including but not limited to raw milk, raw milk products, and meat products from the Association's suppliers. By shopping with us, you become a Member of Oikos Food Buyer’s Club (OFBC) a faith-based Private Membership Association (PMA), and agree to the following:
1) Membership Application and Fees
The Member hereby applies for membership in OFBC with a one-time membership fee of $1 charged upon first checkout. Membership will renew automatically on an annual basis until the Member ends their membership in OFBC. This fee is non-refundable, and membership is subject to annual renewal. Approval of membership is at the sole discretion of OFBC.
2) Private Membership Association Status
OFBC operates as an unincorporated organization that conducts trade with Member(s) only.
3) Purpose of Membership
The Member affirms that their primary intent in joining OFBC is to trade products such as:
- Direct-from-farm products, including but not limited to beef, poultry, lamb, pork, and other available items
- Raw milk, cheese, and other dairy products
- Bone broth
- Eggs
- Cooking fats such as tallow, ghee and lard
- Sourdough goods, flour, corn tortillas, jams
4) Health Disclaimers and Warnings
OFBC is not open to the public. We disagree with the requirements of government regulatory agencies (such as chemicals required) so we believe the food we produce outside of their requirements is a healthier product. Member, on behalf of himself, his agents, heirs, personal representatives, successors, and assigns, expressly acknowledges that not all of the products of the Association are inspected or approved by any governmental authority and that not all of the products of the Association are pasteurized, sterilized, or irradiated and as such may contain pathogens. By obtaining these products, the Member accepts these risks and agrees to use their judgment regarding the consumption and handling of these items.
a) Raw Milk and Dairy: Government agencies have determined that consuming raw dairy products may pose health risks, including listeria. Therefore, a Member consumes raw milk and dairy products from OFBC at their own risk and understands there can be potential health challenges.
5) Order Pickup
Member pick-up will only be during designated & posted pick-up times and locations. If for some reason you cannot make a pick-up, it is the member's responsibility to have a contingency plan for someone else to pick up their order if for some reason they cannot make the pick-up. The association will not be responsible for perishable items after the pick-up window has passed. Perishable items include all items that require refrigeration or have a limited shelf life such as, but not limited to, baked goods.
6) Personal Use
Any food products received shall be for personal use only and shall not be sold and shall not be distributed to anyone outside Member’s family and/or guests.
7) Release.
Member, on behalf of himself, his agents, heirs, personal representatives, successors and assigns, releases and forever discharges the Association and its Members, agents, successors, and assigns from all claims, demands, costs, expenses (including reasonable attorneys’ fees), compensation, damages, losses and causes of action of any nature whatsoever relating to the consumption of food products acquired through the association.
8) Covenant Not to Sue
Member, on behalf of himself, his agents, heirs, personal representatives, successors and assigns, covenants and agrees that Member shall never institute any action or lawsuit against the Association, nor institute, prosecute, or in any way aid in the institution or prosecution of any claim, demand, action, or cause of action for damages, fines, costs or expenses, arising out of the distribution, acquisition or consumption of food products.
9) Entrapment
Member attests and affirms that he is not an agent for a federal, state, or local government agency trying to entrap or investigate the Association and its owners.
10) Severability
If, for any reason, any provision or provisions of this agreement are determined to be invalid and contrary to any existing or future law, such invalidity shall not impair the operation or affect those portions of this agreement which are valid.
11) Member Acknowledgment
By completing checkout, the Member acknowledges that they have read, comprehended, and agreed to all terms and conditions outlined in this agreement. The Member also confirms their consent to join OFBC and/or acquire OFBC products under these terms.
12) Captions
The captions of sections and subsections contained in this agreement are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this agreement.
13) Construction
When necessary for proper construction, the masculine of any word used in this Agreement shall include the feminine and neuter gender; the singular, the plural; and vice versa.
